By accessing and using the Inky Baby™ mobile application and website (the "Service"), owned and operated by North Fork Forager LLC, you accept and agree to be bound by these Terms of Service.
Inky Baby™ provides a platform for designing and ordering custom baby onesies and related products, including a design editor, shopping features, and order fulfillment through third-party printing and shipping providers.
To access certain features, you may need to create an account. You agree to provide accurate information, maintain the security of your login credentials, and accept responsibility for all activities under your account. You must be at least 18 years old or have parental/guardian consent to use this Service.
You retain all ownership rights to designs, images, and text you create or upload. You grant us a limited, non-exclusive license to use your content solely to provide the Service. You may not upload content that infringes intellectual property rights, contains obscene or harmful material, promotes illegal activities, or includes others' personal information without consent.
All prices are displayed in USD. Payments are processed securely through Stripe. Custom-designed products are made to order and are non-refundable unless defective. If you receive a defective or incorrect item, contact us within 14 days of delivery.
Orders are fulfilled by third-party printing partners. Estimated delivery times are not guaranteed. We are not responsible for delays caused by carriers or customs. Risk of loss transfers to you upon delivery to the carrier.
The Service, its design, features, and content are owned by North Fork Forager LLC (Inky Baby™) and protected by intellectual property laws. The Inky Baby™ name, logo, and octopus mascot are our trademarks.
You agree not to use the Service for unlawful purposes, attempt unauthorized access, interfere with or disrupt the Service, use automated systems without permission, or reproduce or distribute any content without authorization.
The Service integrates with Stripe (payments), ShipStation (fulfillment), Google Cloud (image storage), and SendGrid (email). Your use of these services is subject to their respective terms and privacy policies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INKY BABY™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold harmless Inky Baby™, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.
We may suspend or terminate your access at any time for violation of these terms. Provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.
We may modify these terms at any time by posting the updated version. For material changes, we will provide notice through the Service or via email.
These terms are governed by the laws of the State of New York, United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court for intellectual property matters.
If any provision of these terms is found unenforceable, the remaining provisions will continue in effect.
These terms, together with our Privacy Policy, constitute the entire agreement between you and North Fork Forager LLC (Inky Baby™) regarding the Service.
